Except where liability cannot be excluded or limited by law, we assume no responsibility or liability for: (a) fraudulent or inaccurately constructed accounts; (b) technical malfunctions or other failures of devices utilized in the program's operation; (c) inaccessibility or unavailability of networks, wireless services, the Internet, and websites; or (d) matters lying beyond reasonable control.
We do not exclude or limit our liability in cases where it would be unlawful to do so. Hence, we do not in any manner exclude or limit our liability under or in connection with any contract formed based on these Terms for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) matters for which excluding or attempting to exclude our liability would be illegal.
Vuelo retains the right to disqualify any Vuelo user with overdue balances from acquiring Rewards via the Program. Vuelo prioritizes the development of sound financial practices and discourages consumers from assuming more debt than they can feasibly repay. Additionally, if we ascertain that the Advocate has shared the Referral Invite link in a manner that encourages individuals beyond the Advocate's friends/acquaintances to enroll, Vuelo may, at its discretion, disqualify the Advocate from Program participation and invalidate any successful referrals.
